Assumption of Risk & Release from Liability

Standards & Conditions:

Living stands and conditions, as well as standards relating to the provision of utilities, sanitary services and grading. Of accommodations may be different from your own home. You may also find the climate conditions in different locations can affect the full enjoyment of facilities and activities and the provision of services at the accommodation facility or on packages you have purchased.


Liability Release:

I hereby acknowledge and agree that in consideration of being permitted to participate in Hunting, Fishing, Sightseeing, Canoeing, Camping, Hiking, Trekking, Photography and other Guided tours that l am participating under the arrangement of NANIKA GUIDING, its employees, independent contractors and agents, involves risk and danger which are inherent to the forsaid activities, including but not limited to hazards of traveling by motorized vehicle, airplane, boat, hazards of carrying and being in possession of firearms and ammunition, hazards of loss or damage to personal property, immersion in cold water, hypothermia, drowning, inclement weather, slipping and falling, falling objects, or suffering any type of accident or illness in remote areas without easy access to medical facilities.


And, I do hereby acknowledge and agree:

a. Nanika Guiding cannot assume responsibility for any claim, losses, damage, costs or expenses arising out of injury, accident or death, damage, loss or delay of baggage or other property, or delay, inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from . . .
         (i) mechanical breakdowns, dangers inherent to air, water or land travel, fire, government actions, weather and other factors and causes beyond their control.
         (ii) Failure to follow instruction of Nanika Guiding, its employees, independent contractors and agents.
b. I am personally responsible for my preparation prior to participating in forsaid activities. Such preparation will include, but not be limited to my health and physical fitness.
c. that while I recognize Nanika Guiding, its employees, independent contractors and agents will make every reasonable effort to minimize exposure to known risks, that I have personal responsibility to Yearn and follow safety rules and procedures established by Nanika Guiding, its employees, independent contractors and agents and to make them aware at any point in which l question my knowledge of these procedures or my ability to participate in the forsaid activities.
d. that I will refrain from the consumption of alcohol or mind altering drugs while participating in the forsaid activities.
e. that I consent to receive first aid by Nanika Guiding and its employees or medical treatment by medical personal in event of an accident, injury and/or illness during the forsaid activities.
f. that I understand Nanika Guiding reserves the right to pass on to me, any expenditure occasioned by delays or events beyond their control and unscheduled airplane trips for early departures, etc. are to be at my expense.
g. I understand clearly that signing this release, I will be forever prevented from suing or otherwise claiming against Nanika Guiding, its employees, independent contractors and agents for any of the forsaid losses, damages or injury, including death.
h. that I am of sufficient age and mental capacity to sign this CONTRACT AND ASSUMIPTION OF RISK & RELEASE FROM LIABILITY AGREEMENT.
i. I have read this Contract and Legibility and understand its contents, including NO GUARANTEES of Hunting and Fishing Success.

If the person who will be participating in the activities listed above is under the age of (19) nineteen a Parent or Guardian must sign this waiver also.
